Terms and Conditions

The agreement between you and Nebular

These Terms govern your use of the Nebular learning platform. They explain who may use the Service, what we commit to, what we ask of you, and what happens if something goes wrong. Please read them carefully.

1. Acceptance of these Terms

These Terms and Conditions ("Terms") form a binding agreement between you and LLP "Nebular" ("Nebular", "we", "us" or "our"), a company registered in the Republic of Kazakhstan under Business Identification Number 260140003327.

They apply to the Nebular learning platform, including our websites and our mobile applications for iOS and Android (together, the "Service"). By creating an account, entering a school code, or otherwise using the Service, you confirm that you have read and accepted these Terms.

If you do not agree with these Terms, please do not use the Service.

2. Definitions

  • "Learner" — a student who uses the Service to take a diagnostic, practise, or complete homework.
  • "School" — an educational organisation that has an agreement with Nebular and issues school codes to its learners.
  • "School code" — the six-digit code a School issues to a Learner to give them access to the Service.
  • "Content" — problems, lessons, explanations, diagnostics, learning paths and any other material we make available through the Service.
  • "Your Content" — answers, photographs of handwritten work, messages to the AI Tutor, profile details and anything else you submit through the Service.

3. Who may use the Service

The Service is designed for use in educational settings and is intended for school-age learners.

If you are under 14 years of age, you may use the Service only with the consent and supervision of a parent, guardian, or your School. By allowing a learner to use the Service, a parent, guardian or School accepts these Terms on that learner's behalf and is responsible for their use of it.

If you are a teacher, administrator or other staff member of a School, you confirm that you are authorised by that School to use the Service on its behalf.

4. Accounts and school codes

Access to the Service today is granted through a six-digit school code issued by a School. The code identifies the class a Learner belongs to; it does not transfer and must not be shared with anyone outside that class.

You are responsible for keeping your access credentials confidential and for activity that takes place under your account. Tell your teacher, your School or us promptly if you believe someone else is using your account.

A School may issue, reset or revoke codes for its learners. If a School ends its agreement with us, learners who joined through that School may lose access to School-specific features such as homework.

5. What the Service does — and what it does not promise

The Service provides an adaptive diagnostic, a personal practice path, practice problems, homework set by teachers where a School has enabled it, and an AI Tutor. Scope of content is stated in the Service itself and changes over time.

We work to keep the Service available, accurate and useful, but we provide it "as is". We do not promise that it will be uninterrupted or error-free, that every piece of Content will be free of mistakes, or that use of the Service will produce any particular academic result, examination grade or improvement.

We may add, change or remove features, Content and parts of the Service. Where a change materially reduces what the Service does for you, we will give reasonable notice through the Service.

6. The AI Tutor

The AI Tutor is a deliberately constrained assistant. It is built to ask questions, offer hints, and at most work through a single step. It is designed not to give the final answer to a problem.

The AI Tutor generates its replies automatically. Its output can be incomplete or wrong, and it is not a substitute for a teacher, a textbook, or your own reasoning. Check what it tells you, and raise anything that looks wrong using the report button on the problem.

Do not use the AI Tutor to obtain answers in a way your School forbids, and do not rely on it for advice outside school mathematics. We may limit or suspend access to the AI Tutor to protect the Service or its users.

7. Your Content

You keep all rights you already have in Your Content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, process and display it for the purpose of operating and improving the Service, including grading your answers, interpreting photographs of your handwritten work, and maintaining your learner model.

You confirm that you have the right to submit Your Content and that it does not infringe anyone else's rights. Do not submit photographs that contain other people, personal data about others, or anything unrelated to the problem you are solving.

How we handle personal data is described in our Privacy Policy, which forms part of your agreement with us.

8. Acceptable use

When using the Service, you agree not to:

  • share your school code or account access with anyone outside your class;
  • copy, scrape, bulk-download or redistribute the Content, including the problem bank, in any form;
  • attempt to reverse engineer, probe or interfere with the Service, its security, or the systems it runs on;
  • use automated means to access the Service, or to generate answers or activity that do not reflect genuine learning;
  • submit unlawful, abusive, harassing or deliberately misleading material;
  • impersonate another learner, teacher or Nebular, or misrepresent your relationship with a School.

9. Intellectual property

The Service, the Content, the Nebular name and logo, and the software and models behind them are owned by Nebular or its licensors and are protected by the laws of the Republic of Kazakhstan and international treaties.

We grant you a limited, personal, non-transferable and revocable right to use the Service and the Content for your own learning, or — if you are a School — for teaching your own learners. No other rights are granted.

10. Schools and partner access

Where a School provides access to the Service, the commercial terms, the features enabled, and the duration of access are governed by the separate agreement between Nebular and that School. These Terms continue to govern each individual's use of the Service.

A School decides which capabilities are enabled for its learners — for example practice, homework, or both — and may see learning data about its own learners as described in the Privacy Policy. Nothing is shown to a School about a learner that the learner cannot see about themselves.

11. Fees

The Service is currently provided to learners free of charge, and the mobile applications contain no in-app purchases.

If we introduce paid features in future, we will state the price and the terms clearly before you commit to anything, and we will not start charging for something you are already using without telling you first.

12. Personal data

Our handling of personal data — what we collect, why, how long we keep it, and the rights you have — is set out in our Privacy Policy.

It is our stated commitment to process the personal data of learners in Kazakhstan in accordance with the personal data protection legislation of the Republic of Kazakhstan, including in relation to the storage of that data. This is a commitment we hold ourselves to, not a certification by any authority.

13. Suspension and termination

You may stop using the Service at any time. A School may withdraw a learner's access by revoking their school code.

We may suspend or end access where these Terms are broken, where it is necessary to protect the Service or other users, or where we are required to by law. Where it is reasonable to do so, we will tell you first and give you an opportunity to put things right.

Sections that by their nature should survive the end of this agreement — including intellectual property, disclaimers, limitation of liability and governing law — continue to apply.

14. Disclaimers and limitation of liability

To the fullest extent permitted by the law of the Republic of Kazakhstan, the Service and the Content are provided without warranties of any kind, whether express or implied.

We are not liable for indirect or consequential loss, for loss of profit, or for any academic, examination or admission outcome. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for harm caused intentionally or by gross negligence.

15. Changes to these Terms

We may update these Terms. When we do, we will change the "Last Updated" date above and, for material changes, give notice through the Service or by email before the change takes effect.

Continued use of the Service after a change takes effect means you accept the updated Terms. If you do not accept them, please stop using the Service.

16. Governing law and disputes

These Terms are governed by the law of the Republic of Kazakhstan.

We would rather resolve any disagreement directly, so please contact us first. If a dispute cannot be settled that way, it will be resolved by the courts of the Republic of Kazakhstan at the location of Nebular, in accordance with Kazakhstan law.
